The Massachusetts Department of Environmental Protection (MADEP) took another step in establishing a framework to ensure the suitability of soil reused as fill in large-scale fill projects in Massachusetts by issuing a draft Interim Policy on the Re-Use of Soil for Large Reclamation Projects. The draft policy, which MassDEP issued on May 27, 2015, outlines the Department’s proposed interim plan to use Administrative Consent Orders (ACOs) to grant site-specific approval for quarry, sand pit and gravel pit reclamation projects that import 100,000 cubic yards or more of soil as fill material, and applies to projects that began or expanded after May 1, 2015. ACOs issued under the interim policy would require project proponents to develop and implement a Soil and Fill Management Plan that specifies how imported soil will be tested, documented, tracked and managed. Develop and implement a Stormwater Management Plan. Develop and implement a community outreach plan for communicating with the public at key points during the reclamation project, and provide oversight by a Massachusetts Licensed Site Professional (LSP). Penalties would be assessed for non-compliance. MADEP hopes to finalize the Policy by June 30, 2015 and will be effective immediately.
